Introduction

Welcome to Gestalts. These Terms and Conditions ("Terms," "Agreement") govern your use of the Gestalts mobile application ("App," "Service," or "Gestalts") and constitute a legally binding agreement between you ("User," "You," "Your") and TLG Digital Solutions Pty Ltd ("TLG Digital," "Company," "We," "Us," or "Our").

1. About Gestalts

1.1 Our Purpose

Gestalts is a mobile application designed to support parents and caregivers of children who are Gestalt Language Processors (GLP). We provide:

• AI-assisted educational explanations and session-preparation support
• Memory and observation tracking tools (journals, milestones, gestalts, appointment notes)
• Play-session observation organization
• Custom storybook creation for learning
• Parent-controlled reports for practitioner discussions

We are parents of Olivia, a Gestalt Language Processor. We built this App from our lived experience to help families navigate the GLP journey between speech pathology or allied health appointments. We are not medical professionals, we're parents who've been there.

2. Eligibility and Account Requirements

2.1 Age Requirements

To create an account, you must:

• Be at least 18 years of age
• Be a parent, legal guardian, or caregiver with authority to manage a child's information
• Have legal capacity to enter into this Agreement

2.2 Account Creation

When you create an account:

• Provide accurate, complete, and current information
• Maintain the security of your account credentials
• Accept full responsibility for all activity under your account
• Notify us immediately of unauthorized access

3. User Content and Intellectual Property

3.1 Your Content

"User Content" includes all data you input, upload, or generate through the App. You retain ownership of your User Content. By using the App, you grant us a limited license to process, store, and display your content solely to provide the Service.

3.2 Avatar and Storybook Images

Gestalts offers one optional photo-to-character route after a versioned notice and authority/AI-processing confirmations. Gestalts does not save the source photo to your account, but Google Vertex AI processes it globally under current provider terms. General image refinement and arbitrary image inputs remain disabled. Generated characters are stored only if you choose Save and can be deleted through supported controls.

3.3 Our Intellectual Property

Gestalts owns the App itself (code, design, structure), the Gestalts name, logo, and branding. You may not copy, modify, reverse-engineer, or redistribute the App. We do not own Google's AI models, we access these services via API.

3.4 AI-Generated Content Ownership

Content generated by AI features (Coach responses, Play Analysis feedback, Storybook illustrations) is provided to you for your personal use. While we facilitate generation of this content, you receive a non-exclusive license to use AI-generated content for your child's development.

You may not resell or redistribute AI-generated content commercially. AI-generated content remains subject to the terms of the underlying AI service providers (Google).

4. Use of the Service

4.1 Subscription and Payment

Subscription Tiers:

• Free Tier: $0
• Basic Tier: $19.99/month or $199.99/year
• Premium Tier: $69.99/month or $699.99/year

Subscriptions auto-renew unless canceled 24 hours before renewal. Cancel anytime through App Store/Play Store settings. We reserve the right to change pricing with 30 days' notice.

4.1.1 Platform Payment Terms

Payments are processed through Apple App Store or Google Play Store. Their payment terms, refund policies, and commission structures apply. We do not process payments directly or store payment card information.

Refunds are subject to App Store/Play Store policies. Contact us at info@gestalts.com.au for refund requests, and we will work with you and the platform to resolve issues.

4.2 AI Features - Important Disclaimers

Third-Party AI Services: While we use industry-leading AI services (Google Vertex AI, Google Cloud Text-to-Speech), we implement content moderation and safety filters. However, AI technology is not perfect.

Supported text-generation routes use Gestalts-managed service credentials, not your personal consumer-AI account. Before those model calls, configured identifiers are replaced with random request-specific labels and the text is inspected for additional common identifiers. These controls reduce direct identifiers but do not make free text anonymous or untraceable to Gestalts, and information you include may still identify a person from context. Audio must reach the approved speech-to-text processor before the resulting transcript can receive the text controls.

Your Responsibility: You are responsible for evaluating all AI suggestions and seeking professional guidance.

4.3 Content Moderation and Safety

We employ automated content moderation for safety. Interactions with AI features are analyzed for concerning content (suicide ideation, self-harm, child abuse). Flagged content triggers crisis resources and may be reviewed by administrators. Flagged content is retained for 90 days for safety review and mandatory reporting obligations.

5. Third-Party Services and Integrations

We use the following third-party AI services:

• Google: Authentication, database, cloud storage, text-based AI, image generation, play analysis, and voice narration (Google Cloud Text-to-Speech)

We do not own or control these AI models. Service availability depends on third-party uptime. We are not responsible for third-party service failures or changes.

6. Prohibited Activities

You may NOT:

• Use the App for illegal purposes
• Attempt to bypass security or subscription restrictions
• Reverse engineer or extract source code
• Share account credentials with others
• Upload malicious content or viruses
• Attempt to bypass content moderation systems
• Use the Service in ways that pose safety risks

Violations may result in account suspension, termination, or legal action.

7. Disclaimers and Limitation of Liability

7.1 "As-Is" Service

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee accuracy, availability, or fitness for purpose.

7.2 No Medical Advice

Gestalts is not a medical or therapeutic service. GLP Companion responses are general educational information, not personalised advice. You are solely responsible for all decisions regarding your child's care.

7.3 Limitation of Liability

Subject to the above, TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability shall not exceed the amount you paid in the 12 months prior to the claim.

7.4 Australian Consumer Law

For Australian users: Nothing in these Terms excludes consumer guarantees under the Australian Consumer Law. You may be entitled to remedies for major failures with the service.

8. Indemnification

You agree to indemnify and hold harmless TLG Digital Solutions Pty Ltd from any claims arising from: (a) your use of the App, (b) your violation of these Terms, or (c) your violation of third-party rights.

9. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy (/privacy-policy). By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.

Key privacy points:

• We do not sell your data
• Photo-to-character is the only user-photo AI route and requires the current notice and confirmations
• Supported text-generation routes minimise direct identifiers before the model call, but this is pseudonymisation rather than anonymisation
• You control what you share
• You can delete your account and data anytime

10. Termination

You may terminate at any time by canceling your subscription or deleting your account. We may suspend or terminate your account for Terms violations, illegal activity, or service disruption. Upon termination, access is revoked and data may be deleted within 30 days.

11. Dispute Resolution

11.1 Governing Law

For Australian users, these Terms are governed by Australian law and the Australian Consumer Law applies.

11.2 Informal Resolution

Before filing a legal claim, contact us at info@gestalts.com.au to attempt informal resolution. We will respond within 30 days.

12. General Provisions

We may update these Terms with notice via email and in-app notification. Continued use constitutes acceptance. If any provision is unenforceable, other provisions remain in effect. These Terms, together with the Privacy Policy, constitute the entire agreement.

13. Acknowledgment and Acceptance

By using Gestalts, you acknowledge that:

• You have read and understood these Terms and the Privacy Policy
• You agree to be bound by these Terms
• You are at least 18 years old
• You understand Gestalts is a supportive tool, not professional guidance
• AI-generated content may contain errors
• General user-image/refinement inputs remain disabled outside photo-to-character
• Identifier minimisation does not remove every privacy risk from contextual free text or audio transcription
• You have the right to delete your account anytime
