Is Gestalts a replacement for speech therapy?

No. Gestalts is designed to support your child's therapy journey, not replace professional speech therapy. We help you reinforce your specialist's guidance and make the most of the time between appointments.

Who created Gestalts?

Gestalts was built by parents of a Gestalt Language Processor. Every feature exists because we needed it first during our own daughter's language development journey.

Introduction

Welcome to Gestalts. These Terms and Conditions ("Terms," "Agreement") govern your use of the Gestalts mobile application ("App," "Service," or "Gestalts") and constitute a legally binding agreement between you ("User," "You," "Your") and TLG Digital Solutions Pty Ltd ("TLG Digital," "Company," "We," "Us," "Our").

Please read these Terms carefully before using the App. By creating an account, downloading, or using Gestalts, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. About Gestalts

1.1 Our Purpose

Gestalts is a mobile application designed to support parents and caregivers of children who are Gestalt Language Processors (GLP). We provide:

AI-powered coaching for language development strategies
Memory tracking tools (journals, milestones, gestalts, appointment notes)
Play session analysis and feedback
Custom storybook creation for learning
Specialist report generation

1.2 What We Are NOT

Gestalts is NOT:

A medical device or diagnostic tool
A replacement for professional speech therapy or medical care
A substitute for licensed speech, language pathologists (SLPs), occupational therapists, or other specialists
A provider of medical, psychological, or therapeutic advice
An emergency response service

Gestalts is a supportive tool designed to complement, not replace, professional guidance.

1.3 Who We Are

We are parents of Olivia, a Gestalt Language Processor. We built this App from our lived experience to help families navigate the GLP journey between specialist appointments. We are not medical professionals, we're parents who've been there.

2. Eligibility and Account Requirements

2.1 Age Requirements

To create an account, you must:

Be at least 18 years of age
Be a parent, legal guardian, or caregiver with authority to manage a child's information
Have legal capacity to enter into this Agreement

2.2 Account Creation

When you create an account:

Provide accurate, complete, and current information
Maintain the security of your account credentials
Accept full responsibility for all activity under your account
Notify us immediately of unauthorized access

3. User Content and Intellectual Property

3.1 Your Content

"User Content" includes all data you input, upload, or generate through the App. You retain ownership of your User Content. By using the App, you grant us a limited license to process, store, and display your content solely to provide the Service.

3.2 Photo Processing and Deletion

Avatar and Storybook Photos:

Photo is temporarily uploaded to our secure server
Photo is sent to Google to generate an illustrated avatar
Googles Image Model creates a stylized illustration (not a photo)
Your original photo is immediately and permanently deleted
Only the AI-generated illustration is stored (encrypted)

We never permanently store original photos of your child. Only AI-generated illustrations are retained, which you can delete anytime.

3.3 Our Intellectual Property

Gestalts owns the App itself (code, design, structure), the Gestalts name, logo, and branding. You may not copy, modify, reverse-engineer, or redistribute the App. We do not own Googles or ElevenLabs AI models, we access these services via API.

3.4 AI-Generated Content Ownership

Content generated by AI features (Coach responses, Play Analysis feedback, Storybook illustrations) is provided to you for your personal use. While we facilitate generation of this content, you receive a non-exclusive license to use AI-generated content for your child's development.

You may not resell or redistribute AI-generated content commercially. AI-generated content remains subject to the terms of the underlying AI service providers (Google, ElevenLabs).

4. Use of the Service

4.1 Subscription and Payment

Free Tier: Limited features, no credit card required

Premium Tier ($49.99/month or $499/year):

Unlimited AI GLP Companion conversations
Unlimited memory tracking and reports
Unlimited Play Analyzer recordings
Priority support

Subscriptions auto-renew unless canceled 24 hours before renewal. Cancel anytime through App Store/Play Store settings. We reserve the right to change pricing with 30 days' notice.

4.1.1 Platform Payment Terms

Payments are processed through Apple App Store or Google Play Store. Their payment terms, refund policies, and commission structures apply. We do not process payments directly or store payment card information.

Refunds are subject to App Store/Play Store policies. Contact us at info@gestalts.com.au for refund requests, and we will work with you and the platform to resolve issues.

4.2 AI Features - Important Disclaimers

Not Professional Advice:

AI Coach provides educational information and general strategies, not personalised medical advice
AI can make mistakes or provide incomplete information
Always consult licensed professionals (SLPs, therapists, doctors) for clinical decisions

Third-Party AI Services: While we use industry-leading AI services (Google Vertex AI, ElevenLabs), we implement content moderation and safety filters to ensure appropriate responses. However, AI technology is not perfect, and we cannot guarantee AI responses will always be appropriate or accurate.

Your Responsibility: You are responsible for evaluating all AI suggestions and seeking professional guidance for any clinical decisions regarding your child's development.

4.3 Content Moderation and Safety

We employ automated content moderation for safety. Interactions with AI features are analyzed for concerning content (suicide ideation, self-harm, child abuse). Flagged content triggers crisis resources and may be reviewed by administrators. Flagged content is retained for 90 days for safety review and mandatory reporting obligations.

5. Third-Party Services and Integrations

We use the following third-party AI services:

Google: Authentication, database, cloud storage, text-based AI, image generation, play analysis
ElevenLabs: Voice-based AI Coach

We do not own or control these AI models. Service availability depends on third-party uptime. We are not responsible for third-party service failures or changes.

6. Prohibited Activities

You may NOT:

Use the App for illegal purposes
Attempt to bypass security or subscription restrictions
Reverse engineer or extract source code
Share account credentials with others
Upload malicious content or viruses
Attempt to bypass content moderation systems
Use the Service in ways that pose safety risks

Violations may result in account suspension, termination, or legal action.

7. Disclaimers and Limitation of Liability

7.1 "As-Is" Service

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee accuracy, availability, or fitness for purpose.

7.2 No Medical Advice

Gestalts is not a medical or therapeutic service. AI Coach responses are general educational information, not personalised advice. You are solely responsible for all decisions regarding your child's care.

7.3 Limitation of Liability

Subject to the above, TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability shall not exceed the amount you paid in the 12 months prior to the claim.

7.4 Australian Consumer Law

For Australian users: Nothing in these Terms excludes consumer guarantees under the Australian Consumer Law. You may be entitled to remedies for major failures with the service.

8. Indemnification

You agree to indemnify and hold harmless TLG Digital Solutions Pty Ltd from any claims arising from: (a) your use of the App, (b) your violation of these Terms, or (c) your violation of third-party rights.

9. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.

You can delete your account and data anytime

10. Termination

You may terminate at any time by canceling your subscription or deleting your account. We may suspend or terminate your account for Terms violations, illegal activity, or service disruption. Upon termination, access is revoked and data may be deleted within 30 days.

11. Dispute Resolution

11.1 Governing Law

For Australian users, these Terms are governed by Australian law and the Australian Consumer Law applies.

11.2 Informal Resolution

Before filing a legal claim, contact us at info@gestalts.com.au to attempt informal resolution. We will respond within 30 days.

12. General Provisions

We may update these Terms with notice via email and in-app notification. Continued use constitutes acceptance. If any provision is unenforceable, other provisions remain in effect. These Terms, together with the Privacy Policy, constitute the entire agreement.

13. Acknowledgment and Acceptance

By using Gestalts, you acknowledge that:

You have read and understood these Terms and the Privacy Policy
You agree to be bound by these Terms
You are at least 18 years old
You understand Gestalts is a supportive tool, not professional guidance
AI-generated content may contain errors
Original photos are processed and deleted (not stored)
You have the right to delete your account anytime
